    PREFACE

    This Code constitutes a recodification of the general and permanent ordinances of the City of Louisville, Colorado.

    Source materials used in the preparation of the Code were the 1977 Code, as supplemented through February 20, 1996, and ordinances subsequently adopted by the city council. The title organization and section numbers are unchanged and are the same as in the 1977 Code except for sections which have been added. The source of each section is included in the history note appearing in parentheses at the end thereof. The absence of such a note indicates that the section is new and was adopted for the first time with the adoption of the Code. By use of the comparative tables appearing in the back of this Code, the reader can locate any section of the 1962 Code, the 1977 Code, as supplemented, and any subsequent ordinance included herein.

    The Code have been conveniently arranged in titles and chapters, and the various sections within each chapter have been catchlined to facilitate usage. Notes which tie related sections of the Code together and which refer to relevant state law have been included. A table listing the state law citations and setting forth their location within the Code is included at the back of this Code.

    Chapter and Section Numbering System

    The chapter and section numbering system used in this Code is the same system used in many state and local government codes. Each section number consists of three parts separated by a decimal. The figure before the first decimal refers to the title number. The figure after the first decimal is the chapter number. The figure after the second decimal refers to the position of the section within the chapter. Thus, the first section of chapter 1 is numbered 1.01.010. Under this system, each section is identified with its chapter, and at the same time new sections can be inserted in their proper place by using the decimal system for amendments. For example, if new material consisting of one section that would logically come between sections 10.04.010 and 10.04.020 is desired to be added, such new section would be numbered 10.04.015. New chapters may be included in the same manner. If the new material is to be included between chapters 9.02 and 9.04, it will be designated as chapter 9.03.

    Page Numbering System

    The page numbering system used in this Code is a prefix system. The letters to the left of the colon are an abbreviation which represents a certain portion of the volume and the chapter number. The number to the right of the colon represents the number of the page in that portion. In the case of an appendix to the Code, the letter immediately to the left of the colon indicates the letter of the appendix. The following are typical parts of codes of ordinances, which may or may not appear in this Code at this time, and their corresponding prefixes:

    Index

    The index has been prepared with the greatest of care. Each particular item has been placed under several headings, some of which are couched in lay phraseology, others in legal terminology, and still others in language generally used by local government officials and employees. There are numerous cross references within the index itself which stand as guideposts to direct the user to the particular item in which the user is interested.

    Looseleaf Supplements

    A special feature of this publication is the looseleaf system of binding and supplemental servicing of the publication. With this system, the publication will be kept up-to-date. Subsequent amendatory legislation will be properly edited, and the affected page or pages will be reprinted. These new pages will be distributed to holders of copies of the publication, with instructions for the manner of inserting the new pages and deleting the obsolete pages.

    Keeping this publication up-to-date at all times will depend largely upon the holder of the publication. As revised pages are received, it will then become the responsibility of the holder to have the amendments inserted according to the attached instructions. It is strongly recommended by the publisher that all such amendments be inserted immediately upon receipt to avoid misplacing them and, in addition, that all deleted pages be saved and filed for historical reference purposes.

    ORDINANCE NO. 1348
    SERIES 2000

    AN ORDINANCE ADOPTING BY REFERENCE A NEW MUNICIPAL CODE FOR THE CITY OF LOUISVILLE, COLORADO; AMENDING CERTAIN SECTION OF SUCH CODE; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED IN THE CODE; PROVIDING A PENALTY FOR THE VIOLATION OF THE CODE; PROVIDING FOR THE MANNER OF AMENDING THE CODE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.

    WHEREAS, City Staff and the Municipal Code Corporation have prepared a new codification of the general and permanent ordinances of the City of Louisville; and

    WHEREAS, the City Council desires to adopt the new municipal code pursuant to the procedures set forth in Part 2 of Articles 16, Title 31, Colorado Revised Statutes; and

    WHEREAS, the City Council after proper notice as required by law and published in the Boulder Daily Camera on October 21 and 28, 2000, has held a public hearing on this ordinance providing for the adoption of the new Louisville Municipal Code.

    NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO:

    Section 1. The Code entitled the "Louisville Municipal Code 1999," published by Municipal Code Corporation and consisting of titles 1 through 17; the tables and indices thereto; and appendices A, B and C to Chapter 17.28 (the City of Louisville Commercial Development Design Standards and Guidelines; the Design Handbook for Downtown Louisville; and the City of Louisville Industrial Development Design Standards and Guidelines), each inclusive (the "Code"); and supplements 1, 2 and 3 of such Code, is hereby adopted.

    Section 2. All ordinances of a general and permanent nature enacted on or before March 7, 2000, and not included in the Code or recognized and continued in force by reference therein, are repealed.

    Section 3. The Code includes certain substantive changes and additions to the general and permanent ordinances of the City of Louisville enacted on or before March 7, 2000. Such substantive changes are set forth in Exhibit A attached hereto and incorporated herein by reference, and shall be published as required by C.R.S. § 31-16-204. Non-substantive changes to the same shall be posted in the office of the City Clerk. The following, additional amendments are also hereby made to the Code as published:

    Section 4. The repeal provided for in Section 2 hereof shall not be construed to revive any ordinance or part thereof that has been repealed by a subsequent ordinance that is repealed by this ordinance.

    Section 5. The following codes were adopted by reference and incorporated in the Louisville Municipal Code. A copy of each such code is on file in the City Clerk's office.

    Section 6. Unless another penalty is expressly provided, every person convicted of a violation of any provision of the Code, any code or ordinance adopted by reference, or any ordinance adopted or issued in pursuance thereof, shall be punished by a fine of not more than $1,000.00 or a term of imprisonment of not more than one year or both fine and imprisonment as provided in § 1.28.010 of the Code. Each act of violation and each day upon which any such violation shall occur shall constitute a separate offense. The penalty provided by this section, unless another penalty is expressly provided, shall apply to the amendment of any Code section, whether or not such penalty is reenacted in the amendatory ordinance. In addition to the penalty prescribed above, the City may pursue any other remedies provided by law or equity, including but not limited to, abatement of nuisances, injunctive relief and revocation of licenses or permits.

    Section 7. Additions or amendments to the Code when passed in the form as to indicate the intention of the City to make the same a part of the Code shall be deemed to be incorporated in the Code, so that reference to the Code includes the additions and amendments.

    Section 8. The City Clerk shall distribute such sets of the Code and amendments thereto as may be necessary to the various departments of the City for official use of City officers, boards and commissions. All volumes designated for official use shall remain the property of the City for the use of such city officials and their successors and shall bear such designation. The City Clerk shall prepare or cause to be prepared a list of the city officers, and boards and commissions who shall receive for official use copies of such Code. The City Clerk shall make the Code and supplements thereto available to the public, and shall charge therefor such fees as are reasonable and permitted by law.

    Section 9. Ordinances adopted after March 7, 2000, that amend or refer to ordinances that have been codified in the Code shall be construed as if they amend or refer to like provisions of the Code.

    Section 10. This ordinance shall become effective 30 days after its publication as provided by Colorado Revised Statutes section 31-16-105.

    Section 11. The following sections of the Louisville Municipal Code adopted by this ordinance are penalty sections, and said penalty sections are hereinafter set forth in full and reenacted according to Colorado Revised Statutes section 31-16-204:

    Section 12. If any portion of this ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact that any one part be declared invalid.

    Section 13. The repeal or modification of any provision of any general or permanent ordinance of the City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred under such provision, and each provision shall be treated and held as still remaining in force for the purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining and judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, proceedings, or prosecutions.
