§ 16.12.075. Action on preliminary and final plats.

    In deciding whether to approve, approve with modifications, or deny a preliminary plat or a final plat, the planning commission and city council shall be guided by the following standards:

    1.

    Whether the plat conforms to all of the requirements of this title;

    2.

    Whether approval of the plat will be consistent with the city's comprehensive plan, applicable zoning requirements, and other applicable federal, state and city laws;

    3.

    Whether the proposed subdivision will promote the purposes set forth in section 16.04.020 of this Code and comply with the standards set forth in chapter 16.16 of this Code and this title.

    B.

    Nothing in this title is intended to limit the authority of the planning commission granted pursuant to C.R.S. § 31-23-215(2) to impose use, height, area, or bulk requirements or restrictions governing buildings and premises within a subdivision, so long as such requirements and restrictions do not authorize violation of the city zoning ordinance, and the city council shall have the same authority.
