§ 10.24.030. Smoking vehicles prohibited.

A.

It is unlawful for any person to operate or drive a motor vehicle, including a motorcycle, powered by gasoline or other fuel, except diesel, that emits any visible air pollutant as defined by C.R.S. § 25-7-103(1).

B.

Subsection A of this section shall not apply to emissions caused by cold engine start-up.

C.

A valid or current emissions sticker shall not be affirmative defense to subsection A of this section.
